Welcome to Unveil (the "App"), operated by Hello Wenkel LLC ("we," "us," "our"). By creating an account, you agree to these Terms of Service ("Terms"). Our Privacy Policy describes how we collect, use, and retain information, and is incorporated into these Terms by reference.
Unveil is intended for doll collectors and hobbyists and is not directed at children. You must meet the minimum age for your region to use Unveil: 13 years old generally, 15 if you are located in South Korea, and 16 if you are located in the European Economic Area, United Kingdom, Switzerland, Australia, Vietnam, or Brazil. If you are between the minimum age for your region and 18 years old, you represent that a parent or guardian has agreed to these Terms on your behalf.
You're responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You retain ownership of photos and information you upload ("Your Content"). By uploading Your Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, and modify Your Content for technical purposes (such as resizing, format conversion, and generating thumbnails), and to display it as necessary to operate the App — including showing it to other users if you choose to mark a doll or set as public. This license includes the right to sublicense to the hosting, storage, and content-delivery providers we use to operate the App, and continues for a reasonable period after deletion solely to the extent copies persist in routine backups (see our Privacy Policy for how long).
You are solely responsible for Your Content. You represent that you own, or have the necessary rights and permissions to upload, any photo or material you add to the App. Do not upload images you don't have the right to use — including manufacturer photos, stock photos, or images taken from the internet — unless you own them or have permission.
Our designated agent to receive notices of claimed copyright infringement is:
If you believe content on Unveil infringes your copyright, send a notice to our designated agent including: (a) identification of the copyrighted work; (b) identification of the material you claim is infringing and its location in the App; (c) your name, address, phone number, and email address; (d) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; (e) a statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner; and (f) your physical or electronic signature. We will investigate and remove infringing content where appropriate, and may terminate the accounts of repeat infringers.
If content you posted is removed because of a copyright notice and you believe it was removed in error or misidentification, you may send us a counter-notice including: (a) identification of the removed material and where it appeared before removal; (b) a statement, made under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification; (c) your name, address, and phone number, and a statement that you consent to the jurisdiction of the federal court for the district where your address is located (or, if outside the United States, an appropriate judicial district); and (d) your physical or electronic signature. If we receive a valid counter-notice, we may restore the material unless the original complainant informs us they have filed a court action.
Your profile (your username, profile photo, collector title, badges, the date you joined, and your follower, following, and public collection counts) and any doll or set you choose to mark public are visible to people who follow you, and so is your gallery. Your gallery is always public: every photo you add to it is visible to your followers, and it has no private setting. Unveil has no search feature, so finding an account normally requires already knowing its exact username. The one exception is Discover, which is optional and off by default: if you are 18 or older and join the Unveil Society in the App, other users who are 18 or older and don't follow you yet can see that profile, your public dolls and sets, and your gallery in Discover, and can follow you from there. Joining the Unveil Society and browsing Discover are free. Users under 18 can't be discovered and can't use Discover. Following itself does not require your approval (any user who can find your account may follow you, subject only to a rate limit intended to prevent abuse and to any user you have blocked), but you can see everyone who follows you and remove (unfollow or block) any follower at any time. Once marked public or added to your gallery, treat it as no longer private with respect to your followers and, if you've joined the Unveil Society, to Discover users. This includes any personal information incidentally visible in a photo you upload (for example, a person, a location, or a name tag). Removing the public flag, removing a gallery photo, leaving the Unveil Society, or removing a follower stops new visibility going forward but does not retract copies someone may have already seen or saved.
One exception: if you submit a doll for consideration as our featured "Doll of the Month" and it is selected, that doll's photo and description are shown to every Unveil user, not only your followers, and — unless you choose otherwise at the time you submit — you are credited by your username rather than anonymously. A selected submission remains in the App after you delete your account, with your username removed. Submitting requires Premium and that you are 18 years of age or older, and you will be asked to confirm you understand how a selected submission is shown before you can submit.
Don't use Unveil to upload unlawful, infringing, or harassing content, or to harass, impersonate, or block-evade other users. The App includes tools to block other users and to report accounts, dolls, sets, and gallery photos to us; we review reports and take action we consider appropriate. A reported doll or set may be hidden from Discover while we review it, and a reported gallery photo may be hidden from everyone while we review it. Depending on what we find, we may make a doll or set permanently private or remove a gallery photo; restrict an account, which makes all of its dolls and sets private for good, hides its gallery, removes its follows and profile photo, and stops it from following or being followed, while its owner keeps full use of their collection; or suspend an account. If we take one of these actions, we will tell you in the App what we did and why, and you can contact us if you believe we made a mistake.
We may remove any content or suspend or terminate any account, at our discretion, at any time, for any reason or no reason, including a violation of these Terms. You may stop using the App and delete your account at any time from within the App (Profile → Delete Account) or by contacting us. Deleting your account removes Your Content as described in our Privacy Policy; some information may be retained where these Terms or applicable law require it (see Section 3 and our Privacy Policy).
Unveil is free to download and use. The one-time Premium upgrade, which removes ads, unlocks the full badge catalog and profile themes for your public profile, and any optional donation, are both purchased through Apple's or Google's in-app purchase system, as applicable to your device — we do not process either payment ourselves. If Apple or Google refunds a Premium purchase, Premium is removed from your account. Donations are entirely optional, are not required to use any feature of the App, and do not unlock any additional feature or content. We may introduce, change, or discontinue paid features in the future; we'll disclose their price and how it's processed before you pay.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, INCLUDING LOSS OF YOUR CONTENT, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100.
Some jurisdictions don't allow the exclusion of certain warranties or the limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from Your Content, your breach of these Terms, or your violation of any law or the rights of a third party.
You and Hello Wenkel LLC agree to resolve any dispute arising from these Terms or the App through binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court. There is no judge or jury in arbitration, and court review of an arbitration award is limited.
YOU AND HELLO WENKEL LLC EACH AGREE THAT ANY PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this class action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court, and the rest of this arbitration agreement will still apply to all other claims.
You may opt out of this arbitration agreement by emailing contact.unveil@hellowenkel.com within 30 days of first accepting these Terms, with your name and a statement that you opt out of arbitration; opting out does not affect any other part of these Terms.
We may update these Terms from time to time. For material changes, we'll provide notice in-app or by email before the change takes effect; continued use of the App after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict-of-law principles. Subject to Section 11, the exclusive venue for any dispute not subject to arbitration is the state and federal courts located in Prince William County, Virginia, and you consent to personal jurisdiction there.
If any provision of these Terms is found unenforceable, the rest remain in full effect. These Terms are the entire agreement between you and us regarding the App and supersede any prior agreements on the same subject. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce a provision isn't a waiver of it. Notices to you may be given in-app, by email, or by posting on the App. Sections 3 (as to the license's post-deletion survival), 9, 10, 11, and 14 survive termination of your account.
If you downloaded the App from the Apple App Store, this agreement is between you and Hello Wenkel LLC only, not Apple, and Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation for the App. Apple is not responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation. Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the App or your possession or use of it infringes that third party's intellectual property rights. You must comply with applicable third-party terms when using the App. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary.
